ISLAMABAD: The Supreme Court (SC) on Tuesday rejected the Anti Narcotic Force’s (ANF) appeal against the High Court decision to remove Ali Moosa Gillani’s name from the Exit Control List (ECL).
Chief Justice of Pakistan (CJP) Mian Saqib Nisar remarked, “freedom of movement is fundamental right of every citizen. There is no justification for placing Ali Moosa Raza name in ECL. ANF should resort to trial court in connection with placement of his name in ECL. Ali Moosa Gillani has gone abroad and returned to home five times after obtaining permission. The name of any one is not included in ECL like this.”
A 3-member bench of the SC presided over by the CJP took up the case for hearing on Tuesday.
The ANF had filed an appeal against the high court’s decision, praying for the SC to set aside the decision and issue orders for placing Gillani’s name in the ECL.
The court, after hearing the arguments of the parties concerned, upheld HC decision and rejected the ANF’s appeal.
